SPECIAL MEETING MARCH 5, 2020

Supervisor Slucter called to order the Special Meeting to authorize the Zoning Administrator to issue enforcement tickets for violations on Vermontville Hwy and to authorize the Supervisor and Zoning Administrator to issue tickets under the Civil Infraction and Nuisance Ordinance at 6:30 pm.

Present: Slucter, Rumsey, Fritts, Piper, Pray and Fabijancic

Absent: Myers

Rumsey moved and Fabijancic seconded to approve agenda as written. Carried 6-0.

Hear Public Present for Agenda Items: None

Pictures of the E Vermontville Hwy property, Parcel No. 080-023-400-073-00 (the “Property”) were scrolling on the Smart Board while discussion took place on occupancy without proper dwelling, junk, debris and garbage strewn about the Property, inoperable vehicles, construction of utility buildings without required permits, etc. All of which are a violation of the Zoning Ordinance, Section 5.1.6(A), 5.1.6(C), 5.1.7, 5.10, 5.10.3(4)(a) and 6.2.1and Sections 2 and 3 of the Public Nuisance Ordinance. Slucter moved and Rumsey seconded to recuse Slucter from voting on the Zoning Administrator having authorization to issue enforcement tickets. Carried 6-0. Rumsey moved and Pray seconded to authorize the Zoning Administrator to issue enforcement tickets for the violations on E Vermontville Hwy property, Parcel No. 080-023-400-073-00. Carried 5-0.

On occasion it may be necessary for the Supervisor and Zoning Administrator to have the ability to issue tickets under the Civil Infraction and Public Nuisance Ordinance. It was noted by several board members that it’s not unusual for these offices to have this ability. Rumsey moved and Pray seconded to recuse Slucter from voting on the Supervisor and Zoning Administrator having the ability to issue tickets. Carried 6-0. Rumsey moved and Fabijancic supported to authorize the Supervisor and Zoning Administrator to issue tickets under the Civil Infraction Ordinance and the Public Nuisance Ordinance.

Nays: None

Absent: Myers

Motion Carried: 5-0-1

With no further business, Supervisor Slucter adjourned the Special Meeting at 6:42 pm.
