The regular meeting of the Windsor Charter Township Planning Commission was called to order at 7:00 pm by Chairperson Holtz.

Holtz moved and Johnson seconded to approve the amended agenda, adding Terry Haines, 5096 Canal Rd Special Use Permit under Unfinished Business after Fresh Coast Cannabis Group. Roll Call Carried 5-0.
Johnson moved and Sabourin seconded to approve the minutes of the previous meeting as written. Roll Call Carried 6-0.
The
Public Hearing for Fresh Coast Cannabis Group Special Use Permit was called to
order by Chairperson Holtz at 7:02 pm.
Paul
Kountouriotis, representing Fresh Coast Cannabis Group, LLC stated their plans
are to operate a Marijuana establishment at 4955 Lansing Rd, as a Marijuana
Class C grower and a Marijuana processor in accordance with Medical Marihuana
Facilities Licensing Act and the Michigan Regulation and Taxation of Marihuana
Act.
With
no comments or questions from the public, Chairperson Holtz closed the public
hearing for Fresh Coast Cannabis Group Special Use Permit at 7:04 pm.
The
Public Hearing for Terry Haines, 5096 Canal Rd Special Use Permit was called to
order by Chairperson Holtz at 7:04 pm.
Terry Haines confirmed he was a Medical
Marijuana Caregiver for 5 people and himself.
According to the Windsor Charter Township Zoning Ordinance, since the
building he would like to lease space is zoned commercial, he is required to
have a Special Use Permit.
With
no comments or questions from the public, Chairperson Holtz closed the public
hearing for Terry Haines, 5096 Special Use Permit at 7:05 pm.

Trustees: 1) Approval was given on Green
Peak Industries Special Use Permit for 5943 N. Michigan Rd. 2) Public Hearing
was scheduled for the Dangerous Building at 10652 W. Jolly Road for September
22nd to be held electronically.
3) Janice Skabic, Nuisance Abatement Officer, resigned due to health
issues. 4) James Fabijancic resigned as
Trustee as he was accepted into the State of Michigan Trooper Recruit Academy.

variance request for a property on Windsor Hwy, so a deck could be replaced.

An
annual review of Green Peak Industries Harvest Park Medical and Adult Use
Special Use Permits was conducted. Pray
moved and Sabourin seconded to approve renewal of Green Peak Industries Harvest
Park Medical and Adult Use Special Use Permit for another year, as they have
met requirements and include their recently approved Special Use Permit for
5943 N. Michigan Rd to expire on the same date.
New expiration date 10-10-2021.

Unfinished Business:
Fresh Coast Cannabis Group request for a Special Use
Permit for a medical marijuana grow and processing facility at 4955 Lansing
Road was discussed. Further information will be needed at site plan review. Holtz moved and Sabourin seconded to
recommend to the Windsor Charter Township Board approval of the petitioned Special
Land Use Permit for a 11,340-sf medical and recreational marijuana cultivation and
processing facility to be located on the north side of Lansing Rd. and as
legally described in Section 19 of Windsor Charter township (Parent Parcel Tax
ID #23-080-019-100-040-00) based on the following reasoning and conditions:
Reasoning: 1) Subject to the conditions provided below, it is found that the
petitioned special land use meets the general standards as provided for in
Article VIII of the Ordinance. 2) Subject to the conditions provided below, it
is found that the preliminary site plan for a light manufacturing facility
generally meets the general standards as provided for M-1 District and site
development requirements set forth under Section 5.8-A.3. Conditions: 1) Provide information as noted
under Section 3, 4 and 5 of this staff report as having not been provided for
on the site plan or in supplemental information. 2) A final site plan shall be submitted for
final approval by the Planning Commission.
3) All Emergency Services
requirements be met.

Medical Marijuana Caregiver, Terry Haines, has 5
patients and himself and can grow 72 plants.
He plans to lease a space at 5096 Canal Rd for his growing operation. There is no plans to process at this
location. There will be no employees or
customers coming to this location, just himself, so no additional parking is
needed and no added traffic to the area. The building has an adjoining wall
with another business. The space he will
utilize is over 50 feet from the adjoining building. He has charcoal fans and air cleaners to help
mitigate the odor. There is deficiencies in the site plan and other
supplemental information that has been provided. Concern was expressed with having multiple
tenants in one building that has limited separation and sharing of common
interior elements such as electrical, mechanical and doors. Pray
moved and Sabourin seconded to table action on the petitioned Special Land Use
Permit as legally described in Section 15 of Windsor Charter Township (Parent
Parcel Tax ID #23-080-015-300-066-00), until the next available meeting after
staff can confirm the ability to move forward, based on the following
reasoning: 1) Additional information is required to determine if the petitioned
special land use meets the general standards as provided for in Article VIII of
the Ordinance. 2) Additional information
is necessary to determine if the preliminary site plan for a light
manufacturing facility generally meets the general standards as provided for
B-2 District and site development requirements set forth under Section 5.8-A.3.

Discussion took place on Master Plan/Zoning Ordinance. Planning Workshop
has been scheduled for Wednesday, September 30, 2020 at 6:00 pm. A history on Capital Improvement Plans was
given. It was the consensus that the
draft zoning ordinance flows better than existing.
