The regular meeting of the Windsor
Charter Township Planning Commission was called to order at 7:00 pm by
Chairperson Holtz.

Johnson
moved and Sabourin seconded to approve the agenda as written. Carried 5-0.
Pray moved and Johnson seconded to approve the minutes
of the previous meeting as written. Carried 5-0.
The
Public Hearing for Creyts Road Exchange Co Special Use Permit was called to order
by Chairperson Holtz at 7:06 pm.
Jeff Deehan, representative from Creyts
Road Exchange Co. gave an overview of intended use of property. The plans are to build a 44,000 sf steel
industrial building on Lot #5 of Harvest Park and lease out for storage
purposes and/or marihuana related use.
It was noted that due to the building potentially being leased in the
future for marihuana related use, all future occupants must obtain additional
special use permits for their intended use prior to commencement of such
use.
With
no comments from the public, Chairperson Holtz closed the Public Hearing for
Creyts Road Exchange Co Special Use Permit at 7:08 pm.
The
Public Hearing for Lake Life Farms Special Use Permit was called to order by
Chairperson Holtz at 7:08 pm.
David Kotler, representative from Lake
Life Farms, stated that currently they have a medical marihuana special use
permit and are requesting to add adult use marihuana to their existing
facility.
With
no comments from the public, Chairperson Holtz closed the Public Hearing for
Lake Life Farms Special Use Permit at 7:10 pm.
The
Public Hearing for Green Peak Industries LLC Special Use Permit was called to
order by Chairperson Holtz at 7:10 pm.
Joe Neller, representative from Green
Peak Industries, indicated they are requesting a special use permit for a 146,000
sf existing facility located at 9410 Davis Hwy for marihuana related uses. Previously Green Peak Industries requested a
special use permit for an existing building at 5943 N Michigan Rd, there were
parking concerns and too small to meet their needs, so are no longer going to
use that facility. This new facility
meets their current requirements and has potential for future expansion if
needed.
Matt
McNeil, 7977 Centerline, adjacent property owner – Expressed his support of
special use permit.
An
email was sent into the township from John Merten, authorized agent for Windsor
Farms, LLC, and adjacent property to the west with the following concerns: Windsor Farms is concerned that the proposed
use will negatively impact property values in the immediate vicinity. Specifically, Windsor Farms is concerned with
odor mitigation and security. What odor
mitigation procedures will be implemented and what steps will Green Peak take
if those procedures are not successful?
Secondly, what are Green Peak’s security plan? If they could address both issues, it would
be appreciated. Joe Neller address these concerns stating they have
operated in Harvest Park for over 1-1/2 years now with no security issues. As far as odor, have odor mitigation plans in
place today, which include carbon filters.
There have been complaints in the past, but have upgraded and learned
how to maintain the system to better control the odor. Also always looking into new odor mitigation
technology to improve system.
With
no more comments from the public, Chairperson Holtz closed the Public Hearing
for Green Peak Industries LLC Special Use Permit at 7:15 pm.
The regular meeting of the Windsor
Charter Township Planning Commission was reopened at 7:15 pm by Chairperson
Holtz.

Board of
Trustees: Pray reported 1) Reappointed
Fran Johnson and Brian Holtz to the Planning Commission for another 3 year term.
2) The 2021 fee schedule, holiday policy and meeting schedule were
approved. The meeting time for the
Township Board meetings has been changed to 7:00 pm starting January 2021. 3)
Approved the 2021 Local Police Service agreement.

An annual review was conducted on
Unitech Laboratories of Michigan. Holtz moved and Sabourin seconded to approve
the renewal of Unitech Laboratories of Michigan Special Use Permit for another
year. New expiration date December 10,

Unfinished Business:
Discussion was held on Creyts
Road Exchange Co request for a Special Use Permit and Site Plan Review for
storage purposes and/or related marihuana uses on Lot #5 of Harvest Park
(parcel 080-002-100-022-06). Holtz moved
and Collins seconded to recommend to the Windsor Charter Township Board
approval of the petitioned Special Land Use Permit and Site Plan Review for a
44,000-sf engineered steel industrial building to be leased for storage
purposes and/or “marihuana related use” to be located on the northeast side of
Harvest Park Rd and as legally described in Section 2 of Windsor Charter
township (Parcel ID#: 080-002-100-022-06) based on the following reasoning and
conditions: Reasoning: 1) Subject to the conditions provided below, it is found
that the petitioned special land use meets the general standards as provided
for in Article VIII of the Ordinance. 2) Subject to the conditions provided
below, it is found that the preliminary site plan for a light manufacturing
facility generally meets the general standards as provided for M-1 District and
site development requirements set forth under Section 5.8-A.3 and Sections
6.8.9 of the Ordinance. Conditions: 1)
Provide information as noted under Section 3, 4 and 5 of this staff report as
having not been provided for on the site plan or in supplemental information.
2) Due to the nature of the request to
construct an engineered steel industrial building to be leased in the future
for a “marihuana related use” all future occupants must obtain additional
special use permits for their intended use prior to commencement of such use. 3) The
building cannot be occupied for business until a fire safety inspection is
completed and signed off by Windsor Township Emergency Services
Department. 4) The applicant coordinate
inspections between the Emergency Services Department, Eaton County
Construction Codes Department and Bureau of Fires Services inspectors. 5) The facility be made available for a tour
by the Emergency Services Department personnel.
6) The Emergency Services Department will be provided a complete set of
final construction plans and a fire inspection be completed prior to occupancy
and to assist in fire preplanning.
7) Future Issues that will need
to be address: a) Fire Department
Connection (FDC) – two (2) 2-1/2” Siamese Female NST are required (5” Storz is
not acceptable) and will there be a time limit for parking in the area of the
FDC? b) Fire Hydrants – Require 5” Storz
for the steamer connection and two (2) 2-1/2” NST (the connections are to be
facing the Fire Lane). c) Fire Lane
Marking – The Emergency Services will work with the property owner or their
designated representative to mark the fire lanes with signage and/or red
painted curbs. d) Sprinkler System – As
discussed in previous meetings, there will need to be a riser serving each
tenant space and the 40’ x 100’ common area.

Township Board to approve the addition of Adult Use Marihuana cultivation and
processing Special Use Permit to Lake
Life Farms existing facility located at 10350 Harvest Park (Parcel ID#
080-002-100-022-04), renew their Medical Marihuana Special Use Permit for
another year and to coincide the renewal
date for both permits, to expire on January 22, 2022, based upon the following
reasoning: 1) The applicant received
special land use approval for the cultivation and processing of medical
marihuana on January 22, 2019 and has operated in compliance with the
provisions of the Windsor Charter Township Zoning Ordinance since that time. 2)
The proposed adult use marihuana operation will be similar in nature to the
existing medical marihuana use and will take place entirely within the existing
medical marihuana facility.

Lake Life Farms Special Use Permit Recommended for

Green Peak Industries
request for a Special Use Permit for adult-use marihuana indoor cultivation,
processing, packaging and warehouse distribution facility located at 9410 Davis
Hwy, Parcel 080-003-100-023-01 was discussed. Holtz moved and Collins seconded to recommend to the Windsor Charter
Township Board approval of the petitioned Special Land Use Permit a 146,191-sf adult
use marijuana cultivation, processing, and secure transporter facility to be
located on the south side of Davis Hwy and as legally described in Section 3 of
Windsor Charter Township (Parcel ID# 080-003-100-023-01) based on the following reasoning and
conditions: Reasoning: 1) Subject to the conditions provided below, it is found
that the petitioned special land use meets the general standards as provided
for in Article VIII of the Ordinance. 2) Subject to the conditions provided
below, it is found that the preliminary site plan for a light manufacturing
facility generally meets the general standards as provided for M-1 District and
site development requirements set forth under Section 5.8-A.3 Conditions: 1)
Provide information as noted under Section 3, 4 and 5 of this staff report as
having not been provided for on the site plan or in supplemental information.
2) A final site plan shall be submitted
for final approval by the Planning Commission.
