WINDSOR CHARTER TOWNSHIP BOARD
REGULAR MEETING
JANUARY 24, 2023 – 7:00 PM

The meeting was called to order at 7:00 pm by Supervisor Slucter with the Pledge of Allegiance.
Present: Slucter, Rumsey, Fritts, Myers, Piper, Pray and Pisano
Absent: None
Piper moved and Fritts seconded
to approve the agenda as written. Motion carried unanimously.
Myers moved and Piper seconded
to approve the minutes of the previous meeting as written. Motion carried unanimously.
Reports:
Sheriff’s Report: None
Planning Commission: Elected new officers and recommended approving a Special Use Permit renewal to the Township Board.
Sewer Board: Approved Hughes Environmental Services new contract with some minor changes.
Emergency Service Department: Chief Miller reported: 1) From a grant project through Michigan
Prevention, started installing the battery operated smoke and carbon monoxide
detectors in homes free of charge. During install, a complete Fire Safety
survey is provided. Working on obtaining
some detectors for the hearing impaired residents. 2) Emergency Services Annual Report for 2022 was
distributed, there was a 10.45% increase in calls from 2021. 3) Piper moved and Pisano seconded to
accept the resignation of Ryan Cisler.
Motion carried unanimously.
Assessor/Preston Community Services: 1) Met with Equalization to go over the new assessment roll. 2) In keeping with the assessing reform, starting this year property tax assessments will be available online. 3) Met with a possible candidate to manage a building department.
Library: Submitted a Library Millage Proposal for a levy of 0.8 mills to be on the ballot for the May 2, 2023 election. Circulation reports were provided to the township board.
Supervisor’s Report: Gave an update on creating a building department in the near future.
Public Officials: County Commissioner Jacob Toomey reported working on a grant application to obtain additional funding for the broadband agreement with ACD.net and authorized the contract extension for the replacement of the electronic security system within the Eaton County Jail and Eaton county Youth Facility.
Other Reports & Announcements: Trustee Pray reported that former supervisor Art St. Clair passed away on Sunday, January 22, 2023.

Unfinished Business:
Slucter moved and Piper seconded to un-table Green Peak Industries Davis Hwy Facility Marihuana Licensing Permit Application. Motion carried unanimously. Pursuant to the Township Adult-Use Marihuana Establishments Ordinance, as amended, Section 4, subsection 4(c) and the Township Ordinance Authorizing and Permitting Commercial Medical Marihuana Facilities, as amended, Section 4, subsection 3 and based upon the application submitted, plus two subsequent supplemental submittals by Green Peak Industries, LLC (“GPI”) for marihuana permits at 9410 Davis Highway and the information discussed and presented to the Township Board at several meetings, Slucter move and Myers seconded that the Township find the application materials are complete and approve the issuance of the following marihuana permits:

Medical
o
Seven Medical Marihuana Grower Class C Permits
o
One Medical Processor Facility Permit
·
Adult Use
o
Five Adult-Use Marihuana Grower Class C Permits
o
One Adult-Use Marihuana Processor Permit
under the following conditions:
1.
The current
renewal of the Adult Use Special Use Permit for GPI’s Davis Highway property
must also be approved by the Township Board.
2.
GPI must comply
with the conditions of the Adult Use Special Use Permit, local ordinances, and
this approval.
3.
GPI must file
complete Special Use Permit applications for Medical Marihuana Grower and
Processor uses on or before Friday, February 24, 2023 at 4:00 p.m.
4.
GPI must obtain
any necessary medical marihuana licenses to operate such activities within the
Township, including those state-issued adult-use marihuana licenses that
require supporting medical marihuana licenses and must be for both Adult-Use
and Medical Marihuana uses, to the extent that GPI intends to conduct such
activities during the current permit term.
5.
GPI must provide
supplemental notice (if not already) and information to the Township during the
validity of GPI’s adult-use and medical permits for 9410 Davis Highway regarding
any enforcement violations of local ordinances, state law, rules, or
regulations.
6. Any future renewal of GPI’s adult-use and medical marihuana
permits being issued to GPI for its Davis Highway property will be contingent
upon complying with the Township’s ordinances, rules, or regulations; state
law, rules, or regulations; the conditions provided herein; and with any
special use permit(s) or site plan approved for the property.

Rumsey moved and Piper seconded to un-table Green Peak Industries Davis Hwy Facility Special Use Permit Renewal. Motion carried unanimously. Based upon the materials reviewed and information discussed by the Board and Township legal counsel, Slucter moved and Pray seconded pursuant to the Windsor Township Zoning Ordinance (“WTZO”) to accept the Planning Commission recommendation and approve the annual renewal of Green Peak Industries, LLC’s (“GPI”) Special Use Permit (SUP) for adult use marijuana cultivation (grower) and processing facility at 9410 Davis Highway, under the following conditions:
1.
The current
renewal of SUP is for GPI’s adult-use marihuana and is not inclusive of medical
marihuana uses, which have not yet been applied for by GPI. To the extent that
GPI commences any use that requires medical marihuana licenses or land use
approvals, GPI must immediately commence and proceed to receive an SUP and
related zoning approvals prior to commencing such medical marihuana uses.
2.
Based on comments
regarding GPI’s compliance with the phasing of its current approved site plan
that was approved in conjunction with its SUP, GPI must coordinate with the
Township to complete an inspection of the property no later than February 28,
2023, to determine whether the use is compliant with all conditions of the SUP,
site plan, and all applicable Township ordinances, including but not limited to
the WTZO.
3.
After conclusion
of the inspection, the Township will provide a written report to GPI and the
Township Board documenting the results of such inspection.
4.
Within 90 days
thereafter, GPI shall obtain any necessary approvals, including site plan
amendments and/or SUP amendments and approvals to comply with the all
applicable Township ordinances, including but not limited to the WTZO.
5.
Any subsequent
renewal of the SUP for this property will not only include review of the
standards set forth in the WTZO, but will also require review and satisfaction
of the conditions set forth as part of this SUP renewal.

Rumsey moved and Slucter seconded to keep
Creyts Road Exchange Special Use Permit Renewal tabled until regular meeting on
February 28, 2023, to obtain further legal review and allow operations to
continue during this period. Motion
carried unanimously.
Several Township Logo designs were submitted for review by the Township Board. Have concluded that a simple design would be best. A little more modification is still needed.
New Business:
Rumsey moved and Fritts seconded to
table Lake Life Farm Special Use Permit Renewal until regular meeting on
February 28, 2023, to obtain further legal review and allow operations to
continue during this period. Motion
carried unanimously.
