PUBLIC HEARING – 7894 NIXON RD GROUP DAYCARE SPECIAL USE PERMIT

AND REGULAR MEETING

The regular meeting of the Windsor Charter Township Planning Commission was called to order at 7:00 pm by Chairperson Holtz.

 

Present: Holtz, Johnson, Sabourin, Fabijancic, Bowen and Barnhart-Smith

Absent: Pray

Also Present:  Planning Consultant Pete Preston, Asst Chief Fabijancic and Clerk Rumsey

 

Johnson moved and Bowen seconded to approve the agenda as written.  Motion carried unanimously.

 

Johnson moved and Sabourin seconded to approve the minutes of the previous meeting as written.  Motion carried unanimously.


The Public Hearing for 7894 Nixon Rd Daycare Special Use Permit was called to order by Chairperson Holtz at 7:01 pm.

 

Hawa Omar, applicant, has recently purchased a new home at 7894 Nixon Road.  She has an active childcare license, had a group daycare at her previous address in Holt and is hoping to get local zoning approval to transfer the daycare to her new home. 

 

With no comments or questions from the public, Chairperson Holtz closed the public hearing for 7894 Nixon Rd Group Daycare Special Use Permit at 7:02 pm.

New Business:

Discussion was held on PEL Industries Special Use Permit at Lot 8 in Harvest Park.  Motion by Holtz and supported by Sabourin to recommend to the Township Board to approve the renewal of PEL Industries Medical Marijuana Cultivation and Processing Facility Special Use Permit at Lot 8 in Harvest Park.

The amount of land, 6 acres, that was purchased for the Canines for Change proposed facility was confirmed.  Outside lighting was discussed.  Emergency Services conditions were reviewed.   Holtz moved and Johnson seconded to approve the petitioned Site Plan Review, submitted by Canines for Change, for a 6,600 sf structure and associated improvements to house and train service and facility dogs, to be located on approximately 6 acres at the southern end of the almost 20 acre parcel, on the west side of N. Michigan Rd (M-99) approximately 500’ northeast of the intersection of Dimondale Hwy and N. Michigan Rd., legally described in Section 13 of Windsor Charter Township (Parent Parcel, 5707 N Michigan Rd, Tax ID # 23-080-013-200-067-00) based on the following reasoning and conditions:   Reasoning:  1) Subject to the conditions provided below, it is found that the petitioned site plan for a light manufacturing facility meets the general standards as provided for under Section 6.8 of the Ordinance.  Conditions:  1)

The property owner or designated representative is responsible for coordinating Fire Alarm System inspection between Eaton County Construction Codes Department (ECCCD) and Windsor Township Emergency Services Department. 2) The electrical plans be submitted for approval for the fire alarm system prior to installation.  3) The building cannot be occupied until the WTES inspections have been completed and a Windsor Township Emergency Services Occupancy Permit has been issued.  4) That the facility be made available for a tour by the Emergency Services Department personnel.  5) The Emergency Services Department will be provided a complete set of final construction plans and a fire inspection be completed prior to occupancy and to assist in fire preplanning.  6) All of the exterior doors be numbered to assist in the quickest route to an emergency.  Motion Carried.

 

Discussion was held on State requirements for Group Daycare Facilities.  Number of children and staff were considered.  Fencing was touched upon as a state requirement.  Bowen moved and Sabourin seconded to recommend to the township board approval of a Special Use Permit for a Group Daycare Facility at 7894 Nixon Rd (Tax ID #23-080-005-100-006-00) based on the following reasoning and conditions:  Reasoning: 1) Subject to the condition provided below, it is found that the petitioned special land use meets the general standards as provided for in Article 8 of the Ordinance.  Conditions: 1) A conceptual site plan is required as part of a special land use application.  However, given the use being regulated by the State and the Township significantly limited to what it can regulate regarding the specifics of the use, such site plan should be deemed appropriate to review at the Zoning Administrator level of administration.
