REGULAR MEETING

DECEMBER 12, 2023 – 7:00 PM

The meeting was called to order at 7:00 pm by Supervisor Slucter with the Pledge of Allegiance.

Present:  Slucter, Rumsey, Fritts, Myers, Piper and Pray

Absent:  Pisano

 

Slucter moved and Piper seconded to amend the agenda, adding Closed Session, after Hear Public Present On Any Subject, for an update on Legal and Real Estate matters. Motion carried unanimously.  Myers moved and Piper seconded to approve the agenda as amended.  Motion carried unanimously. 

 

Myers moved and Piper seconded to approve the Consent Agenda.  Motion carried unanimously.

 

General Fund consisting of Voucher #35007 through Voucher #35065 equaling: $177,717.49 plus digital transfers and payments of $3,080.29 making a Grand Total of $180,797.78.

 

Payroll Report consisting of Voucher #42498 through #42512 and Direct Deposit #DD4439 through #DD4510 plus digital payments for a Grand Total of $101,566.90.

 

Reports:

 

Sheriff’s Report:  Deputy Holliday reported on incidents in the township. 

    

     Planning Commission:  There is a Public Hearing scheduled for tomorrow’s meeting on a Special Use Permit to construct and operate storage units for a parcel of property located on Lansing Road next to the Dollar General.

 

     Sewer Board: Next meeting scheduled for December 21st at 7:00 pm.

 

     Emergency Service Department:  Chief Miller reported:  1) Significant runs were recounted.  2)   Piper moved and Myers seconded to approve the re-retirement of Dick McMahon from Special Services.  Motion carried unanimously.

 

Assessor/Preston Community Services:  Received the increases from Equalization for next year’s property values.  Property values will be increasing approximately 13% in Agriculture, 5% in Commercial, 8% in Industrial and 10% in Residential. This is the final year of a two-year study. The next study will reflect the slowdown in the market.  Legislature has recently changed the processing of Veteran Exemptions to allow the assessor to submit without having to go through the Board of Review.  Starting in 2025, permanently disabled veterans will no longer have to resubmit every year, they only have to notify if they no longer qualify.

 

Public Service Department:  1) To date, there have been 29 burials, 17 cremations and 12 full burials. 2)  Preparing for snow, graded road and installed snow markers.

 

Supervisor’s Report:  1) After meeting with Eaton County Road Commission (ECRC), provided an update on Harvest Park road and Billwood Hwy.  The idea of posting a bond in the amount of the cost for Harvest Park road repairs was suggested. Legal counsel is working on communicating this idea with the developers.  Money has been allocated for the reconstruction of Billwood Hwy in 2026.  The reconstruction will include a new drainage system.  2) Received notice that Green Peak will be closing.  Green Peak is in Receivership and after a number of financial models were run, the receiver can’t see how the facility can pay for itself.  Production will slow down and stop over the next 90 days.  Green Peak does not own the building, so receipt of property taxes will not be affected.  3) Received letter from Eaton County Treasurer, Bob Robinson, in reference to a transfer of a foreclosed parcel on Hart Hwy to Windsor Township.  This parcel has no real value and is not a sellable piece of property.  Piper moved and Fritts seconded authorizing the supervisor to notify the Eaton County Treasurer that Windsor Township declines the transfer of Parcel 080-065-600-160-00.  Motion carried unanimously.  4)  Update was received on the Eaton County Road Millage Program proposal for 2024.

Unfinished Business:

Legal counsel has reviewed the proposed Ordinance No. 49, Michigan Construction Code Ordinance. A draft Code Enforcement Resolution Establishing Fees was presented for board review and further discussion at the next meeting. Motion by Supervisor Slucter and supported by Trustee Piper to introduce Michigan Construction Code Ordinance, an Ordinance to promote the public health, safety and welfare of the residents of Windsor Charter Township, Eaton County, Michigan, by enforcing the Michigan Construction Code pursuant to the Stille-DeRossett-Hale Single State Construction Code Act, Act 230 of 1972, MCL 125.1501 et seq. (the “Act”), to designate the Windsor Charter Township Building Official as the enforcing official to discharge the responsibilities of the Township under the provisions of the Act, to establish a violation of any provision of this Ordinance as a municipal civil infraction, and repeal all other ordinances or parts of ordinances in conflict with this Ordinance in their entirety.

New Business:

Piper moved and Fritts seconded to approve the December 2023 Budget Amendment as written; increase legal fees by $50,000, IT Support Services by $4,000, Insurance by $14,000, Sheriff Services by $4,000, Emergency Services Repairs/Maintenance by $24,000, Cemetery Repairs/Maintenance by $20,000 and ARPA funds Revenue by $302,311.  This Budget Amendment will add $186,311 to the Fund Balance.  Motion carried unanimously.

 

After discussion on MTA Conference and Elections dates, Piper moved and Rumsey seconded to approve the 2024 Meeting Schedule as written. Piper moved and Rumsey seconded for a friendly amendment, correcting the second meeting dates in September and October.

Rumsey moved and Myers seconded for the Township Board to enter closed session to discuss legal issues and real estate matters in accordance with MCL 15.268.

Township Board went into closed session at    8:06    pm.

 

Motion by Piper, supported by Pray, to come out of closed session.

With no further business Supervisor Slucter adjourned the meeting at 8:20 pm.
