WINDSOR CHARTER TOWNSHIP BOARD

REGULAR MEETING

JANUARY 9, 2024 – 7:00 PM

The meeting was called to order at 7:00 pm by Supervisor Slucter with the Pledge of Allegiance.

Present:  Slucter, Rumsey, Fritts, Myers, Piper, Pray and Pisano

Absent:  None

 

Rumsey moved and Slucter seconded to amend the agenda, adding ACD.net Metro Act Right of Way Permit Extension, under New Business. Motion carried unanimously.  Rumsey moved and Fritts seconded to approve the agenda as amended.  Motion carried unanimously. 

 

Myers moved and Pisano seconded to approve the Consent Agenda.  Motion carried unanimously.

 

General Fund consisting of Voucher #35066 through Voucher #35120 equaling: $2,074,261.00 plus digital transfers and payments of $1,775.09 making a Grand Total of $2,076,036.09.

 

Payroll Report consisting of Voucher #42513 through #42527 and Direct Deposit #DD4511 through #DD4585 plus digital payments for a Grand Total of $102,222.25.

 

Reports:

 

Sheriff’s Report:  Deputy Holliday reported on incidents in the township. 

    

     Planning Commission:  1) At the last meeting, held the public hearing on a Special Use Permit Request for a mini warehousing on Lansing Road (Parcel #080-009-200-030-01).  2) Tomorrow’s meeting, reviewing a Special Use Permit renewal and having an election of Planning Commission officers.

 

     Sewer Board: 1) Permit is in for the dry hydrant.  2) The 2024-25 Sewer Budget has been recommended to the Township and Village boards for approval.

 

     Emergency Service Department:  Chief Miller reported:  1) Significant runs were described.  2) Reviewed the 2023 Annual Report for Emergency Services. 

 

Assessor/Preston Community Services:  Received the study back from Equalization.  The study was for the period starting April 1, 2021 thru March 31, 2023.  The overall changes for residential is an increase of 10%, an increase of 12% in both industrial and agricultural and commercial remains the same.

 

Public Service Department:  1) In 2023, there were 29 burials, 17 cremations and 12 full burials.

 

Supervisor’s Report:  1) Provided an explanation on a check issued, in the amount of $2,000,000, to Windsor Charter Township in the December Check Register detail.  Treasurer Fritts found a great interest rate of 5.61% for 15 months and placed it into a CD (certificate of deposit).  2) Received letter from Jim Mott, Eaton County Commissioner Chairman, inviting Supervisors, City Managers and Village Presidents to attend a meeting on February 2nd, to discuss the county’s long term financial outlook.

 

Public Officials:  County Commissioner Jacob Toomey announced passing of a resolution to defer some senior’s property taxes without additional fees. Contact the Eaton County Treasurer for additional information.

Unfinished Business:

The second reading of Ordinance No. 49, Michigan Construction Code Ordinance was completed.  The draft of the Code Enforcement Resolution Establishing Fees will be considered at the next regular meeting.  Motion by Supervisor Slucter and supported by Trustee Pisano to adopt Ordinance 49, Michigan Construction Code Ordinance, an Ordinance to promote the public health, safety and welfare of the residents of Windsor Charter Township, Eaton County, Michigan, by enforcing the Michigan Construction Code pursuant to the Stille-DeRossett-Hale Single State Construction Code Act, Act 230 of 1972, MCL 125.1501 et seq. (the “Act”), to designate the Windsor Charter Township Building Official as the enforcing official to discharge the responsibilities of the Township under the provisions of the Act, to establish a violation of any provision of this Ordinance as a municipal civil infraction, and repeal all other ordinances or parts of ordinances in conflict with this Ordinance in their entirety.

New Business:

Representatives for Midwest X, LLC presented a conceptual drawing on storage units planned for construction on Lansing Road next to Dollar General.  Still working on details and layout for the final storage unit count.   Plans to meet with Eaton County Drain Commission on storm water prior to submitting for a final site plan review.  Pisano moved and Piper seconded to accept the recommendation from the Planning Commission and approve the petitioned Special Land Use Permit for mini-warehousing on property as legally described in Section 9 of Windsor Charter Township (Parcel Tax ID # 080-009-200-030-01) based on the following reasoning and conditions:  Reasoning: 1) Subject to the conditions provided below, it is found that the petitioned special land use meets the general standards as provided for in Article 8 of the Ordinance.  Conditions:  1) Provide information as noted under Sections 3 through 6 of the staff report as having not been provided for on the conceptual site plan or in supplemental information.  2) A final site plan shall be submitted for final approval by the Planning Commission.  3) Emergency services requirements be met as outlined in letter dated December 12, 2023.

Discussion was held on Windsor Estates of Dimondale mobile home community drinking water system.  Windsor Estates Property LLC, new owners of Windsor Estates, has applied for a public drinking water supply system permit from the State of Michigan, Department of Environment, Great Lakes and Energy (EGLE).  A resolution is being requested from Windsor Charter Township endorsing the owners to continue with the responsibility to provide public drinking water supply system for the Windsor Estates community.  Slucter moved and Myers supported the adoption of Windsor Estates Property LLC owning and operating a drinking water system serving Windsor Estates of Dimondale Resolution.

Resolution adopted.

 

Myers moved and Piper seconded to authorize Clerk Rumsey to sign KEPS Technologies, Inc. dba ACD.net’s METRO Act Right of Way Permit Extension to December 10, 2029.  Motion carried unanimously.
