Resolution to Allow Waiver of Zoning Referral Fee

Resolution 26-001

At a regular meeting of the Windsor Charter Township Board, Eaton County, Michigan, held in the Meeting Room, 300 W. Jefferson, Dimondale, Michigan, on January 27, 26 , at 7:00 p.m.

PRESENT: Shaw, Rumsey, Barnhart-Smith, Myers, Gardner, Slucter, and Pray

ABSENT: None

Board Member Rumsey moved to introduce the following resolution for review and subsequent final adoption, which motion was seconded by Board Member Slucter :

WHEREAS, Windsor Charter Township has established zoning referral fees as part of its Zoning Ordinance and fee schedule; and

WHEREAS, certain applications or referrals may present unique circumstances where waiving the zoning referral fee is in the best interest of the Township; and

WHEREAS, providing limited administrative flexibility can improve efficiency and support Township objectives while maintaining appropriate oversight;

NOW THEREFORE BE IT RESOLVED, by the Windsor Charter Township Board, Eaton County, Michigan, authorizes the Township Supervisor or the Zoning Administrator the ability to waive a Zoning Referral Fee as follows:

1) When a zoning application is considered a simple application, the Supervisor or Zoning Administer may waive a fee.

2) Waiver of a fee may be granted for accessibility projects in compliance with the American Disability Acts (ADA).

3) A simple, residential application for fencing, sheds, out-buildings or other like improvements may be eligible for a fee waiver.

4) A simple non-residential fee waiver may be granted in the Supervisor or Zoning Administer discretion.

5) Applicants may appeal a denial for a fee waiver to the Township Board.

In consideration of the above, there is no obligation to waive a fee, any waiver shall be documented in the application file and report any waiver to the Township Board upon request. This Resolution to Allow Waiver of Zoning Referral Fee is effective Immediately .
